This tailored session for the Senior Leadership Team explores the legal, ethical, and cultural responsibilities outlined in the Worker Protection Act 2023. Preventing Sexual Harassment Training
Quality training is vital to equip leaders to prevent and address such behaviour, as highlighted in Allay (UK) Ltd v Gehlen (2021). While this case involved racial harassment, its principles apply to sexual harassment. The Employment Appeal Tribunal (EAT) found the employer liable because its equality and diversity training was outdated and ineffective, failing to meet the “all reasonable steps” defence.
Learning Outcomes:

Content Overview
Introduction: Understanding the Worker Protection Act 2023: The session opens with an exploration of the Worker Protection Act 2023 using a Mentimeter activity. Participants will reflect on their responsibilities as senior leaders, both individually and as representatives of the organisation. The activity provides a foundational understanding of legal obligations and sets the stage for discussions about proactive prevention and intervention strategies.
Fine Lines: Through an interactive Mentimeter activity, participants will evaluate multiple-choice questions based on hypothetical scenarios of sexual harassment. Scenarios include grey areas where responses depend on context, challenging participants to think critically about nuanced situations. This activity encourages open dialogue and prepares participants to handle complex cases with confidence and clarity.
Senior Leadership Team’s Role: This section focuses on hypothetical scenarios requiring bystander intervention, specifically tailored to the Senior Leadership Team’s responsibilities. Groups will analyse the situations, propose actions, and discuss potential outcomes. Participants will explore how to support and empower employees to intervene while modelling appropriate responses as leaders. The activity includes practical strategies for encouraging a culture where bystander intervention is the norm.
Survivor Testimonies: Participants will hear anonymised or pre-recorded survivor testimonies that highlight the profound impact of harassment on individuals and organisational culture. This activity facilitates a reflective discussion on the emotional and professional toll of harassment, reinforcing the need for preventative measures at all levels of the organisation.
Risk Assessment and Policies: Participants will consider the organisation’s current policies and procedures related to sexual harassment, reflecting on EHRC frameworks and guidance. Through facilitated discussion, they will identify gaps and opportunities to strengthen organisational strategies, ensuring alignment with legal requirements and best practices.
Action Planning and Close: The session concludes with participants reflecting on their key takeaways and developing an action plan tailored to their leadership roles. The plan will include Senior Leadership Team-specific actions to drive measurable change, such as improving reporting processes, enhancing employee training, and embedding accountability into organisational culture.
